Giving Back to CAES

Suggested Will Language

As with other gifts, you may designate Will gifts to benefit the College of Agricultural and Environmental Sciences through The Arch Foundation. For your convenience, suggested phrases for your Will are below.

1. Outright bequest, unrestricted as to purpose:

"I give, devise, and bequeath to the Arch Foundation, a non-profit corporation duly existing under the laws of the State of Georgia and located at Athens, Clarke County, Georgia, (% of estate or $ amount) , to be used for the benefit of the College of Agricultural and Environmental Sciences."

2. Outright bequest to establish endowment fund with income to be:

(a) unrestricted or (b) restricted:

"I give, devise, and bequeath to the Arch Foundation, a nonprofit corporation duly existing under the laws of the State of Georgia and located at Athens, Clarke County, Georgia, (% of estate or $ amount), to constitute the (name of endowment) Fund for the benefit of the College of Agricultural and Environmental Sciences.

This Fund shall be added to the Foundation's endowment to be held in perpetuity and the annual income therefrom shall be utilized:

(a) at the discretion of the Dean of the College of Agricultural and Environmental Sciences, or

(b) for (description of restricted purpose specified by testator C i.e., to provide funds for a specific project or area of the College of Agricultural and Environmental Sciences.) . This Fund, for purposes of investment, may be commingled with other Funds of the Arch Foundation."

3. Bequest of residuary estate:

"All the rest, residue, and remainder of my estate, both real and personal property of whatever kind and wheresoever situated, which I may own at the time of my death, I give, devise, and bequeath to the Arch Foundation, a nonprofit corporation duly existing under the laws of the State of Georgia and located at Athens, Clarke County, Georgia, to be used for the benefit of the College of Agricultural and Environmental Sciences (or for other purpose specified by the testator C see example 2.(b) on page one)."

4. Contingent bequest:

"I give and bequeath to (named beneficiary) (% of estate or $ amount) , but if he (she) shall not be living at the time of my death, then I give, devise, and bequeath such property to the Arch Foundation, a nonprofit corporation duly existing under the laws of the State of Georgia and located at Athens, Clarke County, Georgia, to be used for the benefit of the College of Agricultural and Environmental Sciences (or for other purpose specified by the testator C see example 2.(b) on page one)."

5. Codicil to Last Will and Testament:

"I, JOHN/JANE DAWG, hereby amend my last Will and Testament, executed on the __________ day of __________________, in the year 200___. I direct that all provisions of that Will remain in effect but in addition I give, devise, and bequeath _________________________ to the Arch Foundation, a nonprofit corporation duly existing under the laws of the State of Georgia and located at Athens, Clarke County, Georgia, to be used for the benefit of the College of Agricultural and Environmental Sciences."

In the drafting of all devises and bequests having a restricted purpose, the Arch Foundation respectfully requests the donor and his/her attorney to incorporate a "saving clause." No one can anticipate beyond a few years the changes and developments which may occur at the University and the College of Agricultural and Environmental Sciences. A saving clause might read as follows:

"If at the time this devise and bequest is received by the Arch Foundation for the benefit of the College of Agricultural and Environmental Sciences, or at any time thereafter, the Foundation trustees determine that all or part of said income of the Fund can no longer be utilized to best advantage for the institutional purpose designated herein, then all or any part of said income may be used for such other institutional purpose which, in the sole discretion of said trustees, shall most closely carry out my intention."

The Arch Foundation is a tax-exempt corporation under subsection 501(c)(3) of the Internal Revenue Service Code. All gifts to the Foundation for the benefit of the College of Agricultural and Environmental Sciences are approved charitable deductions according to the schedules established under income tax regulation. Federal Tax ID #58-6033837.
